Abstract

In the commented judgment, concerning a case which received a lot of coverage, namely that of the judge who stole PLN 50, the Supreme Court acquitted the perpetrator on the basis of an in-depth analysis of the mens rea of this offence. The aim of the paper is to draw attention to the important consequences of disciplinary authorities examining the mens rea of a disciplinary tort and expounding the findings in the statement of reasons for the judgment. The author also agrees with the Supreme Court that, like in criminal law and the law on misdemeanours, in disciplinary provisions a perpetrator is liable for theft only when he/she acted with a direct intent.
