Uprawnienia uczelni oraz innych jednostek tworzących system szkolnictwa wyższego wynikające z art. 15a ustawy o prawie autorskim i prawach pokrewnych

The article presents an analysis of the powers that universities and other institutions forming part of the Polish system of higher education were granted by Article 15a of the Act on Copyright and Related Rights, after the 2018 amendments to the Act. Generally speaking, this provision allows universities among other things to use the creative output of students and doctoral students, from their diploma theses and doctoral dissertations. In the article the author explains what theses/dissertations and to what extent may be used by universities and other entities after the amendments to the Act. She indicates the disadvantages and advantages of the solutions and interpretations of the provision accepted in literature so far, focusing mainly on the authors’ interests.
