Abstract
In this article, the author discusses the impact of insolvency petitions on the mortgagee's liability, whose claim is secured by mortgage on the immovable property on which the development project is being conducted, to agree to the free-of-charge separation of dwelling units or detached houses built by the developer. According to the author, this obligation – despite the insolvency of the mortgagee – does not turn into a monetary obligation. It is the responsibility of the liquidator to agree to the free-of-charge separation of built-up dwelling units or detached houses. In the case of liquidation of mortgage receivables by way of sale, the obligation is transferred to the purchaser of receivables in insolvency proceedings.Author | |||||||||
