Abstract

The article analyses the institution of the Minister of Justice or the president of the court ordering the immediate interruption of a judge’s duties. The author’s considerations primarily address the following specific issues: the essence and functions of the order regarding the interruption, who the measure can be applied to, the list of entities that can apply it, the premises and effects of its application, as well as the duration of the interruption of the judge’s duties. It also examines the matter of the judicial review of orders issued in such cases. The considerations lead, in particular, to the conclusion that the order for the immediate interruption of a judge’s duties is a specific variation of the suspension of the judge, as referred to Article 180 of Constitution of the Republic of Poland. Therefore, the author proposes the amendment of the respective laws on the matter in question to bring them into line with the constitutional requirements.
